Planning Obligations Supplementary Planning Document (SPD)

Requirements for Section 106 alongside the Community Infrastructure Levy

The Icon for pdf Planning Obligations SPD [813KB]  sets out West Berkshire's approach to securing planning obligations and developer contributions towards local infrastructure, services and amenities, alongside the Community Infrastructure Levy (CIL). This approach is in accordance with national CIL Regulations and the council's Icon for pdf CIL Regulation 123 List [56KB] .

The SPD provides guidance to landowners, developers and West Berkshire residents.

Developer contributions may be sought, via Section 106 agreements and other statutory measures, in order to provide for additional facilities and infrastructure demands as a result of new development.
 

Adoption of the SPD

The Icon for pdf Planning Obligations SPD [813KB] was formally adopted by the council on 11 December 2014, following a period of consultation which took place in summer 2014. The Icon for pdf Statement of Consultation [159KB] sets out details of all the consultation responses and any changes made to the SPD as a result. The Icon for pdf Adoption Statement [16KB] is also available.

The Planning Obligations SPD will apply to planning applications or appeals determined on or after 1 April 2015.

The Delivering Investment from Sustainable Development SPD applied to applications and appeals determined up to 1 April 2015.
