2. There is no automatic right to compensation – compensation for damage or injury can only be paid when it has been proven that we are at fault for the damage or injury resulting from the incident.

If your claim is for an incident on a road or pavement:

• We have to be at fault for the injury or damage that’s occurred.
• We are not required to pay claims for general wear-and-tear.
• We are not required to check every road daily but we are required to take “reasonable care” to make sure our roads are safe. We look at our maintenance and inspection records over the last 12 months when considering a claim.

You can use this service to report an incident of personal injury or damage to property.

On receipt of your incident report we'll confirm our reference number and let you know if we need any more information from you to investigate the incident.

From 1 August 2024, all new claims will be handled by the Council’s insurer Zurich Municipal, who will contact you directly.

Zurich Municipal will expect to make a decision on your claim within 3 months of receiving the full incident details from you.
