Terms and Conditions for hire of Newbury Library Advice Point Room
Conditions of Hire
1. In these Conditions the following words have the following meanings:-
i. "The Council" is West Berkshire District Council
ii. "The Library" is Newbury Library
iii. "The Hirer" is the person named on the Room Hire Booking Form
2. The Hirer will pay the expenses of making good any damage caused by the Hirer and those attending the event to the building, fixtures, furniture or other property of the Council during or in connection with or in consequence of the occupation by the Hirer.
Anything belonging to the Council lost or missing from any part of the Advice Point during or in connection with any letting shall be paid for by the Hirer.
3. The Hirer shall at the end of the period of hiring ensure the fixtures, fittings, and articles in the Advice point are left clean and in good order and condition.
4. Any cleaning undertaken which, in the opinion of the officers of Newbury Library, is required as a result of the hiring and outside the scope of the agreed hire charge, will be charged to the hirer at the appropriate rate.
5. The Library and Council accept no responsibility whatsoever for any loss of or damage to personal property, howsoever caused, brought into or left in the premises during or as part of the hire of the premises, unless such loss or damage arises as a direct result of the negligence of the Library or the Council.
6. No equipment belonging to the hirer will be used without the prior approval of an authorised representative of the Library, and the installation and use of such equipment will have been agreed by the authorised representative of the Library in advance of such use or installation and the use or installation will be carried out by trained and competent personnel.
7. The Hirer shall not do or permit to be done anything whereby the fire risk to the Advice Point as a whole or any of its contents is extended beyond that covered by the Council's policy or policies of insurance.
8. No exits may be blocked, no chairs or obstructions may be placed in corridors and across doors and no fire appliances may be removed or tampered with.
9. The Hirer shall not permit anything to take place in the Advice Point during the period of hiring which is unlawful or contrary to public decency or good behaviour.
10. Whilst every effort will be made to ensure that there is no disturbance to the internet and telecommunications connection the Council will not accept liability arising from the loss of this connection.
11. The Hirer shall remove all articles brought into the Advice Point immediately at the end of the hiring period. If such articles are not collected within 7 days, the Council reserves the right to dispose of those articles.
12. The hirer agrees to effect Third Party/Public Liability Insurance against any legal liability for loss, damage, demand or proceedings whatsoever, arising under statute or at common law, for damage to property, which shall include the hired premises, or personal injury to or death of any person, caused during or by circumstances arising from, related to or connected with the hire of the premises, on the following basis:
Accidental bodily injury including death to third parties and further in respect of damage to their property - not less than £5 million
Accidental damage however caused to the premises on hire, not less than £5 million
