Education attendance: legal intervention
When support is not effective or not engaged with, legal action may be taken. The pages below explain the different types of legal actions and orders.
Attendance contracts
An attendance contract is a formal agreement between a school, a parent or carer, and sometimes the pupil, designed to improve a child's school attendance.
Education Supervision Orders (ESO)
A legal measure used by local authorities in England and Wales to support children who are not attending school regularly.
School Attendance Orders (SAO)
A legal document issued by a local authority when a child of compulsory school age is not receiving suitable education and is not registered at a school.
Parenting Orders
A legal measure that a court can issue when a parent is found guilty of failing to ensure their child attends school regularly.
Notice to Improve
A a formal written warning issued to parents when a child has unauthorised absences from school.
Penalty Notices (PNs): National Framework (from 19 August 2024)
A Penalty Notice is a fine issued to parents when a child has missed school without authorisation.
